1. Who we are and what these terms cover
Patra (the service) is provided by Aspirence Worldwide Private Limited, a company incorporated in India (we, us). Our registered office address and corporate identity number (CIN) are available on request from hello@trypatra.com.
These terms are an agreement between us and the business or organisation that signs up (you). The person who signs up confirms that they are authorised to accept these terms for that business. The service includes the mailboxes and aliases on your domain, webmail at mail.trypatra.com, access from mail apps (IMAP, SMTP and JMAP), and the admin console at panel.trypatra.com.
The Privacy Policy and the Acceptable Use Policy are part of these terms.
2. Early access
The service is in early access. We are still adding features and changing how things work. We work hard to keep it running and your mail safe, but during early access we do not offer an uptime guarantee or service credits.
3. Your account
- Give us accurate details when you sign up and keep them up to date, especially your contact email address, because that is where we send important notices.
- We review new accounts before they can send mail. We may ask for more information and may decline an account, for example to protect the service from abuse. Until review is complete, your users can receive mail but cannot send it.
- You decide who gets a mailbox and an admin role. You are responsible for what your users do with the service, and for making sure they follow these terms.
- Keep passwords and setup links private. Tell us straight away at hello@trypatra.com if you think someone has accessed your account without permission.
- The service is for businesses and other organisations. Account holders must be at least 18 years old.
4. Your domain
- You may only add domains that you own or are authorised to use. Verifying a domain with DNS records is how you show us that.
- You stay responsible for your domain registration and its DNS. If the records we need are removed, or the domain expires or moves to someone else, mail may stop working and we may stop hosting that domain.
- Mail starts arriving at Patra only when you point your domain's MX record to us. Until then it keeps going to your current provider.
5. Using the service responsibly
Patra is for person-to-person business correspondence. You must follow the Acceptable Use Policy, which forbids bulk and marketing mail, spam, phishing and other harmful use, and sets sending limits. You must also follow the laws that apply to you, including the Information Technology Act, 2000 and the rules made under it.
6. Prices and payment
- Prices are per account, by storage plan, as shown on trypatra.com and in the admin console, plus GST at the applicable rate (currently 18%). A plan covers any number of domains and mailboxes, which share its storage, within the Acceptable Use Policy.
- Plans are billed for a year in advance, or monthly where a plan offers it. A bigger plan applies at once and you pay the difference for the rest of the current period; a smaller plan starts at the next renewal.
- When your account's storage is full, new mail is held and delivered once there is space; mail held for more than 3 days is returned to its sender.
- New accounts are free for 14 days. When the free period ends we issue an invoice for the plan you chose. You can change plans or close your account before the free period ends and owe nothing.
- We issue GST invoices. If an invoice stays unpaid after its due date, we will remind you, and we may then limit the service (first sending, then sign-in) until it is paid.
- We may change prices with at least 30 days' email notice. A change does not apply to a period you have already paid for.
7. Your content
- Your mail, contacts, calendars and files (your content) belong to you or your users. You give us permission to store, process and transmit your content only as needed to provide, secure and support the service.
- Your content is processed by automated systems, for example to deliver mail, filter spam and malware, and build the search index for your mailbox. People at Aspirence do not read your content, except where it is necessary to investigate abuse or a security incident affecting the service, where you ask us to for support, or where the law requires it.
- For the personal data in your mailboxes, you decide why and how it is processed, and we process it on your behalf. The Privacy Policy explains this in detail.
- You are responsible for your content and for having the right to send it.
8. Security
We protect the service with measures that include:
- encrypted connections for webmail, the admin console and mail apps;
- encryption of stored mail and of our servers' disks;
- passwords stored only as one-way hashes;
- signing of the mail you send (DKIM); and
- backups every six hours.
No system is perfectly secure, and you are also responsible for keeping your users' passwords and devices safe. If a security incident affects your data, we will tell you without undue delay and report it to the authorities as the law requires.
9. Availability and changes
We aim to keep the service available at all times, but there may be interruptions for maintenance, upgrades, failures of our providers or events outside our control. We may change, add or remove features. If a change significantly reduces what you can do, we will tell you in advance where we reasonably can. We offer support by email at hello@trypatra.com.
10. Suspension and termination
- You can stop using the service and ask us to close your account at any time.
- We may suspend a mailbox, a domain or your account immediately where this is needed to stop abuse, protect the service, other customers or the public, or comply with the law. Where we can, we will tell you why and give you a chance to fix the problem.
- We may end this agreement if you seriously or repeatedly breach these terms, if you do not pay invoices once billing has started, or, with at least 30 days' notice, for any other reason.
11. Your data when you leave
- You can export your mail at any time with any mail app that uses IMAP.
- When a mailbox is deleted, we keep it for 30 days so it can be restored, then delete it. When your account is closed, we do the same for all of your mailboxes.
- Copies in our backups are deleted within a further 35 days.
- We may keep account and billing records for longer where the law requires it.
12. Warranties and liability
- We provide the service with reasonable skill and care. Apart from that, and to the extent the law allows, the service is provided "as is" and we make no other promises about it.
- Neither of us is liable to the other for indirect or consequential loss, or for loss of profit, revenue, business or goodwill.
- Our total liability to you under or in connection with these terms is limited to the amount you paid us for the service in the 12 months before the event that caused the claim. If you have not paid anything, the limit is ₹5,000.
- Nothing in these terms limits liability that cannot be limited by law, including liability for fraud.
13. Indemnity
You will compensate us for reasonable losses and costs, including legal fees, arising from a claim by someone else that results from your content, from your users' use of the service, or from your breach of these terms or the Acceptable Use Policy.
14. Changes to these terms
We may update these terms. For significant changes, we will email your contact address at least 30 days before they take effect. If you continue to use the service after that date, the new terms apply. If you do not agree, you can close your account before they take effect. The version and effective date are shown at the top of this page.
15. Law and disputes
These terms are governed by the laws of India. The competent courts in India have jurisdiction over any dispute arising from them. Before going to court, please write to us so we can try to resolve the matter informally.
16. Grievance Officer and contact
In accordance with the Information Technology Act, 2000 and the rules made under it, you can reach the Grievance Officer of Aspirence Worldwide Private Limited by email at grievance@trypatra.com.
We acknowledge complaints within 24 hours and aim to resolve them within 15 days. To report spam or other abuse sent through the service, write to abuse@trypatra.com. For anything else, write to hello@trypatra.com.
